Challenging service can be an effective method of fighting foreclosure

On August 28, 2014, a client frantically called me on the phone and explained to me that she came home to a notice on her front door which told her she had to leave her home and take everything in it within 24 hours. Today, 5 months later, I’m happy to say that not only is she still living in the house her fiancé has owned since 1999, but the foreclosure that started this whole mess is essentially, completely voided and must be restarted, all because the bank failed to properly serve the borrower at his New York residence.*

Challenging proper service can be an effective method of fighting foreclosures in difficult cases where judgments have already been entered, and even in some instances, such as the one described above, after a sale has already taken place. The very first things filed in your lawsuit, either individually by you, the defendant, or by an attorney, can work to either preserve or waive your right to raise improper service as defense.
