Is Your House “Underwater”?

What You Can Do If Your House Is Underwater

We’re several years into the housing meltdown and foreclosure avalanche of cases and what have we learned? The “middle class” as usual seems to have been left behind to fend for themselves. Many homeowners are now “underwater”. Preserving the “American Dream” is more difficult than ever and uncertainty seems to rule the day.

Today lenders are in the midst of a “moratorium” as they review their loan documents and legal procedures. With so many homes “underwater, there is little doubt that a new wave of foreclosure filings is soon to hit the courthouses. While legal decisions rendered by appellate courts across the state and nation in the last year have given homeowners and investors more ammunition than ever to defend their property and preserve their rights, there is little doubt fundamental fears persist. To use a sports metaphor, what “quarter” of the financial meltdown are we in? Answer: no one knows for sure!

For those of us representing people “on the front lines” in negotiations and courtrooms across the tri-county area, we have surely learned that people with homes fighting to preserve their American Dream is the only option when dealing with a foreclosure lawsuit. Yet, for millions not sued but “underwater” (meaning they owe more than their home is worth), the question is always, “… is there anything I can do?”. The answer is “You bet!”. Fact is most people “underwater” try it themselves or look for help that too many times turn out to be unqualified or do not have the legal skills to identify the weaknesses in the lenders loan that could serve to encourage an approval. Without a team that understands the legal shortcomings of your particular loan situation, short-sale and loan modification negotiations cannot be successful.

Hiring a law firm that focuses in this area is your best chance of getting a short-sale or loan modification approval for the long-term. So yes, “you bet”, you can do something even when you have not been sued especially if you know it’s unlikely you’ll climb out of that financial hole without help. All you have to do is take ACTION TODAY!

If your home is “underwater”, do not lose your house. The Reyes Law Group helps people aggressively litigate their case, negotiate their loan modification, and/or short-sale  transaction because in the end, YOU too deserve a passionate voice to help you fight to defend your property and/or preserve your rights!
