Real estate developers and investors, new and old, are generally on the lookout for an “experienced” real estate attorney to collaborate with and help them handle the legal issues related to their projects.  Yet, when I hear about someone looking for such an attorney, I know they’re generally talking about “experience.” This manifests itself in how a real estate attorney dispenses legal advice and/or takes legal action.  It is the ability to convey information in an assured, confident manner that only comes from years of handling similar type of transactions and cases over and over and over again.  Thousands of attorneys can showcase their experience in this regard.  Yet, there is another kind of “experience” which dramatically reduces the ranks of experienced attorneys. The real estate attorney who has actually been on the same transactional side as their clients!

I have handled hundreds, if not thousands of closings at this point of my career. It is fair game to say I know a thing or two about the legal issues, conflicts, and nuances you would generally expect to confront in challenging transactions.  (And that doesn’t even serve to recognize the intra-personal skill set you develop over the years of dealing with the myriad of personalities usually involved in each transaction.)  Yet, nothing prepares you to better understand and help a developer, investor, and business client than to have “walked in their shoes!”  This entrepreneurial real estate attorney has been the client, and as such, fully appreciates the concerns, worries and challenges a client faces when they seek legal counsel.

I have experienced first-hand the process real estate investors and developers go through when casting a vision for a real estate project. From creating budgets, pro-forma cash-flow statements, bank applications, construction planning, to coordinating with contractors or tradesmen to assure on-time delivery of product (for construction and/or renovations projects). This all brings the real estate attorney a different perspective and experience.  The varying pressures real estate investors and developers live with when pursuing a property or developing a project, must be “experienced” first-hand to be appreciated.

I have participated as both real estate attorney and developer of various condo conversion projects over the years. Through these experiences, I gained an insight and a better understanding of the big picture and the critical nature of “timing” for real estate projects.  I better understand the stress and strain my clients face. If nothing else, the last 5 years proved that even when they do “everything right,” some things are completely out of their control.   That said, experience is the best teacher – for the developer, investor, and the real estate attorney.  That’s why I often say to would be clients, developers and investors – this entrepreneurial real estate attorney gets YOU!

The current real estate market continues to provide opportunity.  Assembling the correct development team to handle each of the critical functions of the project – financing, construction, accounting, insurance, and legal – is more critical than ever. It is important that your ‘Real Estate Legal Team’ can deliver quality legal work, title work, plus, pragmatic and practical counseling and advice. Even better if it is based on the fact that that they have been in “your shoes!”
